1. DIRECT DEBIT MEMBERSHIP AGREEMENT

As the customer signing the Fitness Membership Application and Direct Debit Membership Agreement, you have authorised Melbourne University Sport (MU Sport) and/or its Direct Debit Agent to debit funds from your nominated bank or credit card account.

The Direct Debit Membership Agreement sets out the terms and conditions of this agreement as follows:

1.1 Direct Debit Payments Are made in advance for the upcoming fortnight, for the agreed amount, as stated on the Membership Application from your nominated bank or credit card account. The Direct Debit Membership Agreement is valid for a minimum of 4 fortnightly direct debits (automated) and then is ongoing.

1.2 Direct Debit Dates A calendar of direct debit dates is provided here. You acknowledge that transactions can take up to 3 business days to appear on the nominated bank or credit card account depending on your financial institution.

1.3 Payment Obligations It is your responsibility to ensure that there are enough funds available in your nominated bank or credit card account to allow your fortnightly direct debit payment to be made. It is your responsibility to keep all financial and contact details up to date with MU Sport. Updated details must be provided 7 days minimum prior to the next debit date.

1.4 Default Fee If your bank or credit card account is rejected for any reason whilst processing your fortnightly direct debit payment, a $15 default fee will be charged. Memberships will not be able to be used until both the outstanding fortnightly direct debit payment and default fee is paid at reception.

1.5 Suspension of Membership Direct debit memberships may be suspended in blocks of 2 weeks, up to a maximum of 16 weeks per calendar year (free of charge), by completing a Membership Amendment form. This request must be submitted 7 days minimum prior to the commencement date of suspension. After the first 16 weeks, a suspension will be charged at $5 per week. All medical suspensions are free of charge upon presentation of a valid medical certificate that covers all requested dates of suspension. Suspensions will not be backdated. To suspend your membership during the MU Sport Christmas/New Year closure, you must request MU Sport to suspend your membership.

1.6 Cancellation of Membership Direct debit memberships may be cancelled at any time (after the completion of minimum 4 fortnightly payments) with the provision of a written cancellation form with 14 days notice (suspension cannot be used throughout this period). Email, over the phone and facsimile, will not be accepted.

2. OTHER MEMBERSHIPS

2.1 Term Memberships 12-month term memberships can be suspended for a minimum of 2 weeks and a maximum of 4 weeks per calendar year. 1 month and 4-month term memberships cannot be suspended.

2.2 Members Aged 13-16 Years Require parental/guardian consent at the time of joining. Parent/Guardian must accompany members aged 13-16 for their initial Introductory Program and any subsequent appointments with Gym Instructors.

2.3 Salary Packaged Memberships Requires a Membership Application and an HR32 form to be completed. Payments are deducted pre-tax from your University salary. Salary packaged fortnightly membership payments are ongoing until you advise MU Sport in writing that you wish to cancel your membership. A period of 14 days written notice must be given to MU Sport. A suspension cannot be used with this membership type.

3. APPLICABLE TO ALL MEMBERSHIPS

3.1 Early Cancellation You may cancel your membership prior to its annual expiry or the minimum term if you provide certification from a registered medical practitioner which explains how your injury, illness or physical incapacity prevents you making further use of MU Sport facilities. If approved, the cancellation will take effect from the date of your application.

3.2 Dispute Notifications If you dispute any direct debit payment, suspension or cancellation, you must notify MU Sport in person, by telephone (03 8344 5405) or in writing via email (memberships-sport@unimelb.edu.au). It is your responsibility to retain any such communication pertaining to the dispute.

3.3 Pricing and Changes to Terms and Conditions MU Sport reviews pricing, terms and conditions annually, with changes taking effect 1 January. Written notice is sent to your email address. In the event that terms and conditions are to change, MU Sport will provide 28 days notice. Current membership conditions are displayed on this webpage (sport.unimelb.edu.au/terms-conditions).

4. ACCESS AND OPERATING HOURS

4.1 Membership Identification Memberships are non-transferable and membership identification must be presented upon entry. Student members who are found to be using another student’s membership may be subject to disciplinary action. Replacement of community membership cards incurs a $20 replacement fee.

4.2 Customer Details It is your responsibility to provide MU Sport with any changes to personal or financial details.

4.4 Member Etiquette Inappropriate behaviour towards any Employee, Contractor, Member or Guest is not tolerated and may result in cancellation of your membership and removal from the premises. Management reserves the right to refuse entry to any person. View Member Etiquette.

4.5 Electronic Devices with in-built cameras are not allowed to be used in change rooms. Mobile phones can be used for listening to music in the gym. Mobile phone calls may be answered in the foyer area only.

4.6 Lockers and Valuables MU Sport provides casual lockers for short-term use (approximately 3 hours). Permanent lockers are available in the Nona Lee Sports Centre for a fee. Lockers are provided as a convenience and in no way represent a high-security storage facility. MU Sport will not be held responsible for goods lost under any circumstances. Locker usage is at your own risk. Casual lockers are cleared nightly with any items found in these lockers placed in lost property.

4.7 MU Sport Operating Hours Are reviewed annually and can be accessed here - http://sport.unimelb.edu.au/fitness/opening-hours. Closures and/or reduced operating hours are included in the membership fees and no refunds or credits are provided for these reduced hours. MU Sport will close all facilities annually on:

  • Good Friday, Easter Saturday and Easter Sunday
  • The duration of MU Sport Christmas/New Year closure period (annual closure dates displayed here - http://sport.unimelb.edu.au/fitness/opening-hours)
  • MU Sport may reduce access hours or close facilities during University holidays - http://unimelb.edu.au/dates. You understand that MU Sport will not reduce, or provide partial refunds of membership fees or automatic suspensions if MU Sport is closed for University holiday, public holiday or duration of the annual Christmas/New Year closure.

4.8 Disclaimer MU Sport will not be responsible for any injury or loss suffered by you whilst using the facilities unless required by law.

4.9 Privacy Any information you have provided MU Sport will be handled in accordance with the University of Melbourne’s Privacy Policy - http://unimelb.edu.au/governance/compliance/privacy.

Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you:

  • are rendered with due care and skill; and
  • are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
  • might be reasonably be expected to achieve any result you have made known to the supplier.

Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the supplier is entitled to ask you to agree that these statutory guarantees do not apply to you. If you sign this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the services provided were not in accordance with these guarantees are excluded, restricted or modified in the way set out in this form.

NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.
